At the hospital, our client was treated for numerous patches of road rash and for complaints of right shoulder and right elbow pain.

I was on my way to a friend’s house from my mom’s house, riding on the sidewalk across the street from my adult school. A man who lives in one of the houses hit me with his van while I was on my bike on the public sidewalk, causing me to lose my balance. He then slammed his door open toward me. He ran my bike over, warping the back tire. He must have run over the bike or something similar because the pedal cranks are now jammed and I can’t even pedal. I called 911 because I was assaulted with his van while on my bike, and he slammed the door on me. He told the cops I was ‘by the truck,’ but then they switched the story to say I was on the sidewalk in their yard on a little concrete patio. I’m surprised the police officers didn’t pick up on that discrepancy, because it tells me they were being dishonest about the whole incident.
The officers wrote both of our statements down. I would like to sue him in civil court for the damages to my bike. I was not physically hurt, but he still intentionally drove his vehicle into my bike to knock me off balance and slammed the driver-side door open. I honestly saw him reach for something in his car and then go into his house to grab something else, so I left my bike and ran for my life because he tried to assault me. I was riding my bike on a bike lane with all proper precautions such as bike lights, helmets, etc. I was going forward down a road and this driver was on the left side of the road waiting to make a left turn.
