AU Team

The Abrahamson & Uiterwyk Attorneys and Injury Law Team

“A system of hiring an attorney on an hourly basis rewards inefficiency, creates delays and commonly creates negative issues between the lawyer and the client. Representing clients on a contingency basis in which the law firm earns a percentage of the settlement, however, is much more rewarding for the client and the injury attorneys.”

Recent Car Accident Settlement Example

$350,000 Recovered – Car Accident Settlement

In this tragic accident, our client was a passenger in a vehicle being operated by a medical transport company driver. As the driver prepared to change lanes on U.S. 441 in Palm Beach County, FL, she suddenly lost control of the car as a result of overcorrecting as the vehicle pulled to the left. Skidding across the roadway, the vehicle rolled over onto its roof and ultimately collided with a guardrail.

Our client had to be airlifted to the nearest trauma center in West Palm Beach. He was suffering from pain in his neck, left shoulder, lower back, right side, and abdomen. Imaging studies showed that he had sustained a herniated disc in his neck and multiple bulging discs in his neck and back. Our client followed up with his orthopedic surgeon for pain in his back, right knee, and left shoulder. Later testing revealed that he had suffered a serious shoulder separation injury. His right knee, which had been operated on only a few days before the crash and for which he was being transported to the doctor at the time of the crash, was also reinjured and he underwent physical therapy for it.

The driver of the transport vehicle had only $50,000.00 in insurance coverage, and, given the significance of the injuries involved, her company quickly paid those limits to our client. We then discovered that the driver’s employer had an additional liability policy with a limit of $300,000.00. We prepared a detailed and comprehensive settlement package for the insurance company and demanded that they pay the full limit of their coverage. Recognizing their substantial liability, the company was convinced to tender its $300,000.00 to our client.

Following the payments by the insurance companies, we also worked hard to reduce the health insurance and worker’s compensation liens that our client was obligated to pay from his settlement. We were ultimately able to cut those liens substantially and save our client additional money. He was very happy with the outcome and with our representation.

Some of Our Jupiter, FL Practice Areas

Car Accidents: In 2015, the National Highway Traffic Safety Administration reported road accident deaths saw the largest increase in 50 years, with approximately 40,000 fatalities reported, equivalent to filling a small football stadium. Florida ranks fourth in the nation for per-capita traffic accident deaths, with 50 times as many injuries annually. If you’ve been injured in a car accident, contact us to speak to a nearby car accident attorney in Jupiter today.

Drunk Driving Accidents: Driving while intoxicated is beyond mere negligence, and if a driver injures you in this way, you are entitled to compensation. It can get tricky, however, in proving just how much compensation you may be entitled to. In some cases, you can also recover damages from a bar or nightclub that sold alcohol to the defendant.

Truck Accidents: Truck accidents in Jupiter are often more severe, involving commercial drivers and potentially leading to long-term disabilities or wrongful death claims. Fortunately, violations of trucking regulations can help prove negligence. If you’ve been in a truck accident, we can help you seek justice. Contact us today!

Bicycle Accidents: In Jupiter, bicycles are often seen as more vulnerable than motorcycles on the road, leaving riders feeling like “second-class citizens” compared to motorists. Even minor car collisions can turn catastrophic when involving a bicycle.

Birth Injuries: Birth injuries occur more frequently than you might imagine. Under some circumstances, it can be difficult to trace the injury to medical malpractice. Since many of these injuries involve lifelong consequences and long-term medical treatment, however, justice dictates that healthcare providers be held financially responsible when professional negligence is involved.

Pedestrian Accidents: Pedestrian fatalities make up about 15% of Florida’s road accident injuries and deaths, and these numbers have been increasing recently. These accidents are especially devastating, often resulting in serious injuries or fatalities, with children being particularly vulnerable. We’re committed to fighting for your full compensation under Florida personal injury law.

We also handle the following case types:

If your injury doesn’t fall within one of these categories, rest assured that we can handle just about any type of personal injury claim.

Personal Injury FAQs

A letter of protection is a document guaranteeing that if you win compensation in a lawsuit judgment or private settlement, your healthcare provider will be paid out of that compensation before you even see the money. A letter of protection is designed to prevent your healthcare provider from instituting collection activity (suing you over your unpaid medical bills, for example) until you resolve your claim.

Most of the time you can’t, because most trucking companies hire their drivers as independent contractors, not employees. An employer is liable for the on-duty conduct of its employees even if the employer itself was not negligent, while a company that hires an independent contractor is liable only for the conduct of the contractor if it acted negligently (by negligently hiring a dangerous driver, for example).

You can still sue the truck driver, who as a commercial driver is likely to be covered by liability insurance.

For injuries caused by an airbag, if you can prove that the airbag was defective and unreasonably dangerous, you can probably sue anyone in the chain of distribution of the airbag – the manufacturer, the distributor, the wholesaler, or the retailer – without proving that any of these parties were actually at fault. You can sue a retailer, for example, for a manufacturing defect, even though the retailer didn’t manufacture the airbag. Of course, if the accident was caused by a negligent driver, you would also want to sue the driver (or file a claim against the insurance company) for his or her contribution to your injuries.
