A contingency legal fee is the amount a lawyer receives when a case is successfully settled or won after trial. When you’ve been injured due to someone’s negligence, you need an experienced attorney near you on your side. Contingency fee agreements allow everyone access to the justice system even if they can’t afford to pay for a lawyer.
Contingency fee arrangements can seem too good to be true, but in these cases, the lawyer takes on any risk that a case may not be successful and pays all case-related expenses upfront. Upon a successful resolution of a case, clients reimburse the lawyer for these expenses. Case-related expenses may include filing fees, deposition expenses, and costs paid to expert witnesses.
Here is an example: a lawyer wins a settlement of $100,000 in a motorcycle accident case where the Florida contingency fee agreement calls for a 33-1/3% fee to the lawyer, the lawyer would receive $33,333.33. If the lawyer had incurred $2,000 in case-related expenses during the course of the case, that amount would be subtracted from the remaining settlement to the client. If the case is not successful, however, the lawyer is out that $2000 of expenses and the hours he or she put into the case while the client isn’t responsible for paying anything.

The amount of an experienced lawyer’s contingency fee will depend on a number of different factors. Most legal contingency fees in Florida are 33-1/3% if the case settles before a lawsuit is filed, and 40% if a lawsuit is filed. The amount may also depend on the case’s complexity, the nature of the injuries, and the client’s needs.

Our client was disabled from a back surgery she had approximately three weeks before the motor vehicle accident that brought her to our firm. She was a passenger traveling on Carillon Parkway in Pinellas County, Florida with her husband driving when they came to a stop and waited to turn right onto Roosevelt Blvd. Unfortunately, the defendant, who was traveling behind our client, negligently failed to stop and struck our client’s vehicle in the rear.
Our client immediately realized that she had re-injured her back and was also experiencing pain in her neck. She went to the emergency room for treatment. In follow-up with an orthopedic surgeon, it was determined that she had further aggravated her back condition. Her doctor felt that a repeat surgery would be necessary. Prior to surgery, our client underwent conservative care and also tried injections in an effort to alleviate the pain. Unfortunately, these measures failed. Ultimately, she underwent an extensive lower back fusion operation.
The defendant had a $50,000.00 bodily injury policy. We demanded that they pay their limits before our client’s surgery took place which they agreed to do. Our client also had uninsured motorist coverage through her own insurance company in the amount of $200,000.00. After we provided a comprehensive demand package, the company offered only a small amount to settle the case. We steadfastly insisted that they pay the policy limits to our client. They continued to refuse, so our firm filed a civil remedy notice accusing the company of bad faith settlement practices. It was not until after a lawsuit was filed that the company finally decided to policy limit, and the case settled for a total of $250,000.00.
