Actual Injury Cases We Have Helped Our Clients With
Palm Harbor, FL Personal Injury Case Types We Handle Near You
Car Accidents: Florida roads are some of the nation’s most dangerous, unfortunately. Someone dies about once every three hours, and someone has probably been injured in an accident in the time that it has taken you to read this article thus far. About 25 percent of injury accidents are alcohol-related, and many more are caused by careless activities such as texting while driving. Our Palm Harbor car accident lawyers are here to ensure you get proper care and coverage after your accident.
Motorcycle Accidents: Motorcycle riders are often at a disadvantage when it accidents on the road due to cars and trucks being larger, heavier, and better protected than motorcycles. Our Palm Harbor motorcycle accident lawyers will be with you every step of the way to get you the compensation you’re owed after an accident.
Bicycle Accidents: Bicyclists share the road with vehicles far heavier and faster-moving than bicyclists. In some ways, a bicyclist is even more vulnerable than a motorcyclist, because it is often impossible for a bicyclist to accelerate out of a dangerous traffic situation. Moreover, when bicycle accidents do happen, catastrophic injuries are often the result.
Brain Injuries: The brain is the most marvelously complex organ in the human body. Since it functions as the body’s command and control center, when the brain is injured, the resulting disability is frequently catastrophic. Dangerously, you might not even be aware of a brain injury for weeks or even months after it occurs.
Product Liability: When a defective product causes an injury, a number of legal theories are available to a resourceful products liability lawyer, including strict liability, negligence, misrepresentation, and breach of warranty. In some cases, the victim doesn’t even have to prove misconduct on the part of the defendant to win the case.
Drunk Driving Accidents: Drunk driving crashes are among the most avoidable of all road accidents. A drunken driver can be held liable for an injury even if his or her blood alcohol concentration (BAC) falls below the DUI limit. Even so, more than 25 percent of all traffic deaths are DUI-related.
Birth Injuries: Nearly one percent of all deliveries involve birth injuries. While most are not serious, some cause lifelong debilitation. In some cases, the mother also suffers significant injuries. Birth injuries, if caused by professional negligence, are a form of medical malpractice, and proving liability might require the use of a medical expert witness.
Slip and Fall Accidents: Slips, trips, and falls are a common cause of injury here in Florida, but liability can be difficult to prove, and insurance companies work hard to ensure they pay as little as possible when someone is injured in an accident. We are here to ensure they pay. Our Palm Harbor slip and fall lawyers work to make sure the insurance companies pay you what you’re owed.
Construction Accidents: Construction work causes more occupational injuries and deaths than any other form of labor, with the possible exception of coal mining. Most construction injury claims fall within the scope of workers’ compensation insurance. Other construction injuries, however, are exempt from workers’ compensation recovery limitations and can be pursued as ordinary personal injury lawsuits.
Pedestrian Accidents: Pedestrian injuries are far more common than most people realize – pedestrians make up about 15 percent of all road deaths. Even pedestrians who survive their injuries are often left with lifelong disabilities, which require continuing medical treatment.
We also handle the following types of cases:
- Truck accidents;
- Florida golf cart accidents;
- Medical malpractice;
- Dog bites; and
- Nursing home abuse.
This is only a partial list of the types of cases we handle – the basics of Florida personal injury law apply no matter what kind of injury you have suffered.
Recent Car Accident Settlement Examples
Our client was a 59-year-old entrepreneur when he was involved in this motor vehicle crash. Our client was headed westbound on Hillsborough Ave. in Tampa near the intersection of Webb Rd. The defendant was traveling east on Hillsborough and made a left turn right in front of our client violating his right of way. The resulting collision caused serious injuries to our client.
He was taken to the hospital with complaints of wrist, shoulder, arm, and upper back pain. CT scans were performed which showed a protruded disc in his lower back. Our client followed up with an orthopedic surgeon who ordered MRI scans of the neck, back, and wrists. Of particular concern was the finding of a herniated disc in the neck which was pressing against the spinal cord. Our client thereafter began treatment with a neurosurgeon who recommended that we have an operation to relieve the pressure on the spinal cord. Due to his severe pain, our client had the surgery performed at two levels of his cervical spine. Fortunately, the surgery was a great success.
The defendant who caused the accident had only a $25,000.00 bodily injury policy. Her insurance company offered to pay that amount after it received our demand. Our client also had uninsured motorist coverage from two different sources. The first insurance carrier had a $50,000.00 policy and after some negotiation, they offered to pay the limits to our client. The second company had a $250,000.00 and initially offered only $30,000.00. We repeatedly refused to accept anything other than the policy limits. When the insurance company continued to resist payment, we filed a notice of bad faith settlement practices against them with the department of insurance. After this, the company relented and finally agreed to pay out the full limit of uninsured motorist coverage, and we were able to secure a full settlement of $325,000.00. Our client was very pleased with our representation and happy with the result.
Frequently Asked Questions
Florida is a modified comparative negligence state. This means that if you are found to be no more than 50% at fault for the accident, your recovery is reduced by the same proportion as your percentage of fault. As an example, if you are found to be 20% at fault in an accident, you may still recover 80% of your damages in a lawsuit. If, however, your percentage of fault is found to be more than 50%, you are barred from any recovery under the law.
Without question, the sooner you obtain legal advice and legal representation, the more likely it is that you obtain proper compensation for your injuries. We make every effort to quickly file our clients’ injury claims and we immediately start the process of collecting evidence as soon as possible after the accident.
Fortunately, most cases are resolved without the necessity of filing a lawsuit. That being said, there are certain legal deadlines that apply. Notifying your car insurance company of the car accident details is something that needs to be done immediately after the accident. Delays in notifying your car insurance can result in the loss of your car insurance coverage. Also, there is a very brief deadline for obtaining medical care under the terms of your Personal Injury Protection policy (PIP/No Fault). If not complied with, then you likely lose the benefits of your car insurance policy.
Some deadlines relate to deadlines for the filing of a lawsuit and others pertain to other legal deadlines. The deadline for filing a lawsuit is referred to the statute of limitations. The statute of limitations for filing a lawsuit for a car accident in Pinellas County – and all of Florida – is generally two years. However, there are many exceptions. For example, if there’s an uninsured motorist policy (issued from a Florida uninsured motorist policy), that statute of limitation could typically be extended. If the car insurance policy is issued from a different state, then there would be different deadlines. Also, there are other deadlines…some of which are very brief.
That being said, waiting too long can cause issues with your case, including lost records, incomplete record-keeping, or parties involved may move or die. Also, evidence may be eliminated and witnesses’ recollections diminish over time.
We always recommend that injured victims contact us as soon as possible after an accident so we can help them maximize their rights to recovery.
Maybe. The question of liability in this instance depends on the details of the occurrence. The essential question is whether the restaurant had a reasonable opportunity to either dry the floor or warn of its hazardous condition by the time of your personal injury. If a customer spilled a soda on the floor ten seconds before you slipped, for example, the restaurant could argue that it had no reasonable chance to dry the floor before your injury. If, on the other hand, the floor was wet because an employee mopped it but failed to erect a warning sign, you might have a good chance to establish liability.

3 Driving Safety Tips for Palm Harbor, Florida
When it comes to driving in Palm Harbor, FL, avoiding accidents altogether is the best plan. Most driving tickets or accidents stem from the urge to rush, whether it’s to make an appointment or get back home from work. Here are some safety tips to avoid the “rush” that often precedes a traffic accident:
- Mind Your Speed:
Keep an eye on the speed limit and adjust your driving accordingly. It might seem like common sense, but it’s easy to slip into driving a tad too fast without even noticing. Rushed driving ranks high among the causes of car accidents in Florida.
- Minimize Distractions:
Minimize distractions while behind the wheel. Distracted driving stands as a significant catalyst for accidents and can also push you towards speeding. Keep your phone out of sight, refrain from eating or drinking while driving, and focus on the road ahead.
- Plan Ahead to Avoid Traffic Congestion:
Before hitting the road, check for road closures and traffic jams. Congested roads often breed frustration and the temptation to speed. Planning your route and steering clear of known trouble spots can save you from getting stuck in traffic and feeling the need to rush to catch up on lost time. Utilizing traffic apps or websites can provide valuable insights into road conditions and closures before starting on your journey.

The Abrahamson & Uiterwyk Attorneys and Injury Law Team
“A system of hiring an attorney on an hourly basis rewards inefficiency, creates delays and commonly creates negative issues between the lawyer and the client. Representing clients on a contingency basis in which the law firm earns a percentage of the settlement, however, is much more rewarding for the client and the injury attorneys.”
