We represented a 31-year-old client in this car crash case. Our client was traveling south on Broad Street in Brooksville, FL approaching the intersection with Whitman Road. The defendant, traveling the opposite direction on Broad St. failed to see our client and attempted to turn left onto Whitman Rd. directly in front of our client causing a serious crash.
Our client was transported to the hospital with head, neck, and back pain immediately after the accident. There he was examined and underwent CT scans and was told to seek follow-up treatment. Our client began treatment with a sport medicine physician, who initially recommended MRI scans for the neck and back. These scans revealed herniated spinal discs in both the neck and lower back. Our client was thereafter referred to an orthopedic surgeon who performed nerve blocks and epidural steroid injections to help relieve the pain.
In March of 2023, the Florida Legislature passed a tort reform bill that disadvantaged injured people in numerous ways. The new law applied to any case filed in court after it was passed. Therefore, we proactively filed a complaint on behalf of our client in circuit court before the new law took effect so that the previous law would apply to his case.
