$1,000,000 Head On Collision Red Light Car Accident Settlement – Rotator Cuff Injuries

On the way to work, our client, who was riding a motorcycle was approaching an intersection that was controlled by a traffic light. As our client was proceeding through the intersection on a green light, the defendant driver made an illegal left hand turn on a red light, resulting in a head on collision. Our client was ejected from the motorcycle and suffered multiple significant injuries. The defendant was cited for causing the accident.

Our client was transported via ambulance to the hospital and was initially treated for broken bones to the arms, wrist, and fingers and was placed in an arm sling and asked not to move the arms much until the fractures healed.

Shortly thereafter, the client began to treat with an orthopedic surgeon and was prescribed physical therapy. A few weeks after the accident the client noticed the development of significant pain to both shoulders. MRIs were taken which revealed rotator cuff injuries to both shoulders. The orthopedic surgeon believed the injuries to both shoulders were directly caused by the motor vehicle accident. The client had arthroscopic surgeries to both shoulders to alleviate the pain.

The defendant’s insurance company initial offer was only $115,000. That low-ball offer was rejected by our law firm. The insurance company took the position that the shoulder injuries were not caused by the accident because our client did not complain of shoulder pain until weeks after the accident and claimed that our client was at fault for causing the accident.

A suit was filed and at the same time our office represented our client in a traffic court case. The defendant hired an attorney to represent him in the traffic court case. The defendant’s attorney denied his client was at fault and initially denied his client was driving the truck involved in the accident. Our office was able to meet with an eyewitness who clearly identified the defendant driver and established the defendant driver was at fault for causing the accident. After numerous continuances, the judge eventually found the defendant driver guilty of violating our client’s right of way.

During the civil suit the defendant’s deposition was taken. He admitted he was at fault after a lengthy deposition. The deposition of the eyewitness was also taken to establish fault. A mediation was eventually set to resolve the case which then settled for $1,000,000.

$451,956.68 Right Turn Red Light Car Accident Settlement Amount – Neck & Herniated Disc Injuries

Our client was involved in an accident on the corner of Florida Avenue and Zach Street East in downtown Tampa, FL. She was traveling northbound on Florida Ave N in the middle lane. She had a green light, and was crossing the intersection of Zach St E. The defendant was traveling Westbound on Zach St E and was making a right turn on a red light onto Florida Ave N. The defendant’s vehicle suddenly, and unexpectedly pulled out in front of her. The defendant violated Plaintiff’s right of way and caused the accident.

State Farm insured the defendant. They denied liability and stated the plaintiff was at fault for running a red light. State Farm offered only $9,500.00 before the lawsuit was filed. The offer was immediately rejected by our office.

The case was referred to our Tampa office for litigation. They immediately filed suit and had our in-house private investigator take a recorded statement of a parking valet attendant that was listed on the accident report as an eyewitness. Our investigator determined that the parking attendant was standing on the corner of Florida Avenue North and Zach Street East at the time the accident happened and verified that the Eastbound light on Zach Street East was red at the time of the accident. The witness went on to explain that the other vehicles traveling next to plaintiff’s vehicle were proceeding through the intersection on a green light. Our Tampa office obtained the traffic sequence report for that intersection and verified that if the light for Eastbound Zach Street East was red at the time of the impact, the light in the opposite Westbound direction had turned red also. The combination of the eyewitness and the traffic light sequence report firmly established that the defendant was the sole cause of the accident.

A videotape deposition of the eyewitness, the defendant and the plaintiff were taken shortly after the suit was filed. At that time State Farm was given the opportunity to pay the nominal $50,000 bodily injury liability policy. State Farm did not accept the conditional time limited demand.

Our client sustained significant injuries to her neck as a result of the automobile accident. All conservative measures failed to alleviate her neck pain which was caused by a large herniated disc and several other small herniations at multiple levels. Her orthopedic spine surgeon recommended a multi-level neck surgery which our client agreed to. The surgery was a success.

The case eventually proceeded to a non-binding arbitration before trial. The arbitrator awarded $451,956.68. The case ultimately settled for that amount several weeks before trial. This is a case where State Farm was forced to pay $401,956.68 over its $50,000 bodily injury policy limits because State Farm did not fairly and accurately evaluate the nature and extent of our client’s injuries. $110,000 Rear-Ended Red Light Car Accident Settlement – Cervical, Thoracic & Lumbar Back Injuries

Our client was stopped at a red light in Pinellas County when she was rear ended at a moderate rate of speed by the defendant. After the accident, our client had an evaluation with an orthopedic surgeon and was diagnosed with segmental and somatic dysfunction of the cervical, thoracic and lumbar region. She was referred to a chiropractor where she began a routine of physical therapy.

When the conservative care failed to resolve her pain complaints, the client underwent a thoracic and lumbar MRI. The MRI’s were reviewed by a neurosurgeon, who ultimately diagnosed our client with a thoracic herniation and lumbago-sciatica caused by disc displacement in the lumbar spine.

Due to the unresolved sciatica complaints, our client underwent medial branch block injections in her lower back. When these injections did not significantly reduce the sciatica pain, our client had a radiofrequency ablation performed in her lower back as well. After the ablation were concluded, a demand for the respective policy limits were sent to the defendant’s insurance company and to our client’s insurance company. Our attorneys convinced both insurance companies to pay their entire policy limits. Accordingly, we were pleased that our clients received the maximum insurance proceeds for their injuries.

$450,000 Rear-Ended Red Light Car Accident Settlement Amount – Herniated Disc Injuries

Our client was stopped at a red light when the client’s vehicle was rear-ended by the defendant. Our client sought medical attention and treatment with various doctors who prescribed a neck and lower back MRI which revealed multiple herniated discs. All conservative treatment failed.

During pre-suit a demand was made to the defendant’s insurance company. The defendant’s insurance company paid the limited $10,000 bodily injury limits. A demand was then made to our client’s underinsured motorist insurance company. The underinsured motorist insurance company responded with an offer of only $9,000.

A lawsuit was filed, and the case progressed through the litigation process. During litigation, our client’s orthopedic spine surgeon recommended neck surgery. Our client submitted to the surgery in hopes of alleviating the neck pain and radiating symptoms.
